In the light of the obligations to provide information to data subjects (“the individual person to whom the personal data refer”) laid down in
Article 13 of Legislative Decree 196/2003, BORGO CASTELLO S.r.l.s. hereby provides you with the following information:
1. Purposes of processing
We will process your personal data and those of your family, which you provide when you register during the check-in procedure and which
we reproduce in the hotel guests’ Welcome Card’, for the following purposes:
a) to fulfil the obligations laid down in Article 109 of the Italian Consolidated Police Act (Royal Decree 773 of 1931) and the more recent
Decree issued by the Italian Home Ministry of 7 January 2013, which require us to record the particulars of our guests and transmit them to
the police in digital form;
b) to fulfil current administrative, accounting and tax obligations and comply with current laws and regulations;
c) to fulfil accommodation tax collection obligations (Decree Law 78/2010, as amended and converted by Law 122/2010);
d) for normal client management;
e) to debit your credit card, left with us as security, with the cost of your stay, including any amounts left unpaid on your departure;
f) to fulfil the obligations laid down in the Italian Data Protection Law (Legislative Decree 196/2003), and particularly:
· in order to carry out the functions of delivering post and parcels, receiving messages and telephone calls for yourself or your family
(subject to your explicit consent as indicated on the Welcome Card);
· to preserve your personal particulars in our information system in order to facilitate registration procedures in the event of your staying
with us again in future (subject to your explicit consent as indicated on the Welcome Card);
· to send periodic promotional and commercial information to your postal address and/or to your e-mail address regarding changes in rates
made and special offers granted by BORGATA CASTELLO CASE E GIARDINI and to transmit a customer satisfaction questionnaire to
your e-mail address after your stay (subject to your explicit consent as indicated on the Welcome Card).
If BORGATA CASTELLO comes into possession of any sensitive information (as defined in Article 4, paragraph 1, of Legislative Decree
196/2003) regarding yourself (such as requests for a disabled person’s room, special diets, sensitive data regarding members of your
family), we hereby inform you that these data will be processed by authorised personnel with the utmost confidentiality and in compliance
with Authorisation no. 5 of the Italian Data Protection Authority.
2. Provision of data
It is obligatory to provide your personal data for the purposes set out in paragraph 1 (a), (b), (c) and (d) above, which are essential in order to
put your presence in our hotel facility on a regular basis. Should you refuse to provide your personal data for these purposes, it will be
impossible for us to accommodate you in our house, since the fulfilment of express legal requirements is involved.
On the other hand the provision of your personal data for the purposes set out in paragraph 1 (f) above is optional, and you must therefore
give us your explicit consent to their processing for these purposes by putting crosses in the consent boxes on the Welcome Card.
3. Method of processing
Your personal data will be processed with the help of digital tools and following manual procedures, and may consist of any operation or set
of operations among those stated in Article 4, paragraph 1 (a), of the Italian Data Protection Law by specially appointed personnel.
4. Transmission of data
Your personal data will be processed by personnel in the hotel belonging to BORGO CASTELLO S.r.l.s., who have been appointed to carry
out this task and have been suitably trained in the matter of the security of personal data and the right to privacy; your personal data may be
a) public bodies or offices pursuant to legal and/or contractual obligations;
b) the authorities competent for client registration obligations under Article 109 of the Italian Consolidated Police Act and the Decree issued
by the Italian Home Ministry on 7 January 2013;
c) debt collection firms and banks for the management of receipts and payments in connection with the performance of the contract;
d) third party suppliers (hire firms, etc.) to meet the requirements for providing the services you request;
e) any specially appointed advisors and external firms that provide consulting services on our behalf (tax, IT, security, CCTV, etc.).
Your personal data will be processed throughout the duration of the contractual relationship that has been entered into and also subsequently
in order to carry out all the legal formalities involved and, in the event of your explicit consent, for future commercial and marketing
purposes in relation to services promotion campaigns in the form of sending publicity material or the utilisation of other commercial
5. Data Holder and Data Controller
Pursuant to Article 28 of Legislative Decree 196/2003, the Data Holder is BORGO CASTELLO S.r.l.s. with registered office at Piazza
Castello, 1 – 18027 Chiusanico (Imperia).
6. Data subject’s rights
Pursuant to Article 7 of Legislative Decree 196/2003, you may exercise your rights at any time (e.g. ask for confirmation of the existence of
your data, ask for them to be updated, rectified, supplemented, erased or blocked or object to their being processed for legitimate reasons) by
contacting our Data Controller at the above address.
